Title: Amends Employment Requirements

Vote to pass a bill that submits a constitutional amendment to the voters that prohibits employees from being required to join or pay dues to labor organizations as a condition of employment.

Highlights:

  • Prohibits labor organizations from forming agreements with employers requiring an individual to become or remain a member of a labor organization as a condition of employment (Sec. 1).
  • Prohibits an employer from requiring an individual to do either of the following as a condition of employment (Sec. 1):
    • Refrain from membership in a labor organization; or
    • Require the payment of dues, fees, or other charges to a labor organization.
  • Authorizes individuals denied employment in violation of this amendment to recover any damages from the employer sustained as a result of the denial of employment (Sec. 1).

NOTE: AN AMENDMENT TO THE CONSTITUTION REQUIRES THREE-FIFTHS APPROVAL IN EACH CHAMBER FOR PASSAGE. IT MUST THEN BE APPROVED BY A MAJORITY OF CITIZENS VOTING IN THE NEXT ELECTION TO BECOME EFFECTIVE.
