Vote to pass a bill that expands the information abortion providers are required to obtain from abortion patients on the Individual Abortion Form, effective November 1, 2013.

Highlights:

• Expands the information a physician is required to obtain on the “Individual Abortion Form” including, but not limited to, the following information (Sec. 1):
• The hospital location at which the physician has admitting privileges;
• The amount of time between the performance of an ultrasound and an abortion;
• A copy of the ultrasound image;
• The reason, if any, an ultrasound is not performed prior to the abortion;
• The probable post-fertilization age of the fetus; and
• The sex of the fetus if the abortion was performed on a minor.

• Expands the information provided in the Department of Health “Annual Abortion Report” including, but not limited to, the following information (Sec. 2):
• The number of male and female fetuses aborted;
• The number of abortions performed in which the woman was informed prior to the abortion that the fetus was a female;
• The number of abortions performed through the administration of chemicals;
• The mean fetal gestational age; and
• The number of abortions in which the abortion patient was told that the fetal heartbeat was audible.

• Authorizes an individual who is a resident taxpayer in Oklahoma to initiate legal proceedings against an abortion provider who does not submit a required report if the taxpayer submits a petition to the Department of Health that is signed by at least 10 registered voters of the state (Sec. 3).

• Specifies that if the resident taxpayer’s claims are determined by a court to be meritorious then the abortion provider is required to submit the report and pay a $500 fine, court costs, and “reasonable” attorney fees of the resident taxpayer (Sec. 3).

• Specifies that if the resident taxpayer’s claims are determined by a court to be frivolous then the individuals who are parties to the lawsuit will be liable for all “reasonable” attorney fees and court costs of the abortion provider (Sec. 3).

• Requires the provisions of this bill to be enforced even if provisions of this bill are temporarily or permanently restrained or enjoined by judicial order (Sec. 4).
