Vote to pass a bill that requires law enforcement to collect DNA from individuals arrested on felony charges, effective July 1, 2014.

Highlights:

• Requires “authorized personnel” to collect a DNA sample from an individual who is arrested, indicted, or charged with a felony, whereas existing law requires a DNA sample to be collected from an individual convicted of a felony (Sec. 2).

• Defines “authorized personnel” as an agent of state or local government who is properly trained in DNA sample collection (Sec. 1).

• Requires the jailer or local correctional officer to submit the DNA sample to the Department of Kentucky State Police Forensic Laboratory (Sec. 2).

• Authorizes a DNA sample to be collected at any point during a felony charge if a DNA sample was not previously collected or the previous DNA sample was lost, damaged, destroyed, contaminated, or otherwise unusable (Sec. 2).

• Authorizes the individual to apply for removal and destruction of the DNA sample and record if the felony case resulted in an acquittal, dismissal, or conviction for only non-felony offenses (Sec. 3).

• Prohibits collected DNA samples from being used to identify any medical or genetic disorders (Sec. 3).
