Vote to concur with House amendments and pass a bill that expands the definition of "abortion clinic" to include facilities that provide abortion inducing drugs.

Highlights:

• Expands the definition of "abortion clinic” to include facilities that provide abortion inducing drugs and requires those facilities to meet all the licensing requirements of an abortion clinic, beginning January 1, 2014 (Sec. 2).

• Exempts the office of a physician where abortion inducing drugs are not the primarily dispensed or prescribed drug from being defined as an abortion clinic (Sec. 2).

• Prohibits the State Department of Health from exempting any abortion clinic from licensing requirements after December 31, 2013 (Sec. 4).

• Prohibits a physician from dispensing, prescribing, or administering an abortion inducing drug to a patient after 9 weeks of gestation, unless the Food and Drug Administration has approved use of the drug after 9 weeks (Sec. 5). 

• Requires the physician to examine the patient in person and perform an ultrasound before prescribing or dispensing an abortion inducing drug (Sec. 5). 

• Requires a patient seeking an abortion to be provided an opportunity to view the fetal ultrasound imaging and to listen to the fetal heartbeat before the abortion is performed (Sec. 6).

• Specifies that if the patient does not want to listen to the sound of the fetal heartbeat or view the ultrasound imaging, the patient must certify refusal in writing and on a form developed by the state department (Sec. 6).

• Requires a physician or medical professional performing an abortion to provide the patient with a color copy of an informed consent brochure at least 18 hours prior to the procedure that contains the following, but not limited to (Sec. 6):
• The name and contact information for the physician;
• Information about the procedure or abortion inducing drug, including the potential risks; and
• The probable gestational age of the fetus.

Vote to pass a bill that requires an ultrasound prior to the prescription of an abortion inducing drug, effective July 1, 2013.

Highlights:

• Requires the physician at an abortion clinic to perform an ultrasound on the patient prior to the prescription of an abortion inducing drug (Sec. 5).

• Expands the definition of an “abortion clinic” to include any facility that provides an abortion inducing drug, whereas existing law only includes clinics that perform surgical abortions (Sec. 1).

• Exempts the offices of physicians in which abortion inducing drugs are not the primarily dispensed or prescribed drug from being defined as an abortion clinic (Sec. 1).

• Requires the physician who prescribes an abortion inducing drug to schedule a follow-up appointment with the patient approximately 14 days after the administration of the drug to confirm through appropriate testing that the pregnancy is terminated (Sec. 5).

• Requires the physician to make a reasonable effort to ensure the return of the patient for the follow-up appointment, who is not required by law to attend the appointment (Sec. 5).

• Requires the physician to report any adverse effects of the abortion-inducing drug to the medical licensing board of Indiana within 3 days of learning of the adverse effect (Sec. 5).
