Title: Establishes Immunity for Doctors Prescribing or People Present to Lethal Dosage

Vote to adopt a substitute amendment to SB 77 that establishes immunity for doctors prescribing, and for individuals present at, the self-administration of a lethal dosage.

Highlights:

  • Prohibits physicians who prescribe a lethal dosage of a double effect medication to an individual with a terminal condition from being subject to criminal liability, civil liability, or professional disciplinary action if the physician warns the individual about the effects of the medication and the individual self-administers the medication and dies as a result (Sec 1).
  • Defines “double effect medication” as a medication prescribed to relieve pain that also has the effect of hastening or increasing the risk of death (Sec. 1).
  • Defines “terminal condition” as an incurable and irreversible disease that would, within reasonable medical judgment, result in death within 6 months (Sec. 1).
  • Prohibits individuals who are present when an individual with a terminal condition ingests a lethal dose of medication prescribed by a physician and dies as a result from being subject to criminal or civil liability (Sec. 1).
  • Requires the Board of Medical Practice to adopt a rule that lists the drugs that may be used for the purposes of this bill (Sec. 1).
