Vote to pass a bill that prohibits an individual other than a physician from administering any abortion-inducing drug, effective July 1, 2013.

Highlights:

• Prohibits any individual other than a physician from administering, selling, dispensing, or providing any abortion-inducing drug for the purpose of inducing an abortion (Sec. 4).

• Requires the prescription for the abortion-inducing drug to by written in compliance with the protocol authorized by the Food and Drug Administration (FDA) on the final printed label (Sec. 4).

• Defines “abortion-inducing drug” as a medicine, drug, or other substance prescribed or dispensed with the intent of terminating the clinically diagnosable pregnancy of a woman (Sec. 3).

• Defines “final printed labeling” as the FDA-approved informational document for an abortion-inducing drug which outlines the protocol authorized by the FDA and agreed upon by the drug company applying for FDA authorization of that drug (Sec. 3).

• Requires a physician to determine gestational age of the fetus prior to providing an abortion-inducing drug (Sec. 4).

• Requires the physician who administers the abortion-inducing drug to contract with another physician who has admitting privileges at a hospital (Sec. 4).

• Requires a physician to schedule a follow-up visit at least 14 days after the administration of an abortion-inducing drug (Sec. 4).

• Requires a physician who provides an abortion-inducing drug for purposes other than that of inducing an abortion to report his or her actions to the State Department of Health (Sec. 5).

• Classifies a violation of this bill by a physician as a misdemeanor and authorizes the physician’s license to be denied, revoked, suspended, or limited (Secs.6 & 10).

• Authorizes civil malpractice actions against a physician who violates the provisions of this bill (Sec. 7).

• Specifies that any provision of this bill determined to be invalid is severable from the other provisions of this bill (Sec. 9).
