Title: Prohibits Smoking in a Car with Minors Present
Vote to pass a bill that prohibits smoking in a car when a child is present, effective July 1, 2014.
- Prohibits individuals from smoking in a motor vehicle when a child 15 years of age or younger is a passenger (Sec. 1).
- Exempts individuals operating convertible or open-body type motor vehicles that are in the open-air mode from the provisions of this bill (Sec. 1).
- Requires that enforcement of the provisions of this bill to be a secondary action when the vehicle is detained for a separate suspected violation (Sec.1).
- Establishes a $45 fine for violations of the provisions of this bill, which may be waived if the individual (Sec. 1):
- Has not previously been convicted of a violation of this bill; and
- Proves to the court that the individual has enrolled in a smoking cessation program.
- Requires law enforcement officers to issue warnings instead of citations for violations of the provisions of this bill until July 1, 2014 (Sec. 1).
