Vote to concur with House amendments and pass a bill that increases requirements on facilities that offer abortion services, effective March 31, 2013.

Highlights:

  • Requires that any facility that performs 120 or more surgical abortions per year and publicly advertises outpatient abortion services must be licensed as a freestanding surgical outpatient facility (Sec. 20115).
  • Requires the facility to meet all regulations associated with becoming a freestanding surgical outpatient facility, including but not limited to (Sec. 20115):
    • Annual licensing fee;
    • Structural building regulations; and
    • Regular inspections.
  • Requires the physician or the physician’s assistant to determine the following information at least 24 hours prior to the procedure (Sec. 17015):
    • If patient has not been coerced into the procedure; and
    • The probable gestational age of the fetus.
  • Requires the physician or the physician’s assistant to convey the following information to the patient at least 24 hours prior to the procedure (Sec. 17015):
    • The probable gestational age of the fetus;
    • What to do should medical complications arise;
    • How to obtain pregnancy prevention information from the Department of Community Health;
    • A written description of the procedure and the fetus at current gestational age; and
    • The Department of Community Health pamphlet on prenatal care and parenting information.
  • Prohibits a physician from diagnosing or prescribing an abortion without personally performing a physical examination of the patient (Sec. 17017).
  • Requires that all fetal remains older than 10 weeks to be disposed of by burial, incineration or cremation, unless the patient has provided written consent for research on the remains (Sec. 2836).
