Vote to pass a bill that increases requirements for operating a sweepstakes terminal device facility.
Highlights:
Prohibits an individual from operating sweepstakes with the use of a sweepstake terminal device at a sweepstakes terminal device facility unless the individual has obtained an annual certificate of registration (Sec. 1).
Defines “sweepstakes” as a game, contest or other advertising scheme where consideration is not required for an individual to enter to win or become eligible to receive a prize and determination is based on chance alone (Sec. 1).
Exempts the following state approved gambling from the definition of sweepstakes (Sec. 1):
Bingo;
Pari-mutuel wagering;
Lotteries operated by the State Lottery Commission; and
Casino gambling.
Prohibits a sweepstakes merchandise prize from exceeding a wholesale value of $10 (Sec. 1).
Requires an individual to register with the Attorney General and pay a filing fee to obtain an annual certificate to operate a sweepstakes terminal device facility (Sec. 1).
Requires a certified sweepstakes terminal device operator to file a sweepstakes terminal device monthly report with the Attorney General and pay a filing fee no later than the tenth day of each month (Sec. 1).
Authorizes the Attorney General to fulfill the following responsibilities (Sec. 1):
Adopt rules on types of schemes that are prohibited schemes of chance;
Determine the filing procedure for a sweepstake terminal facility license;
Refuse to issue a license; and
Revoke a license.
Classifies a violation of the provisions of this bill as a fifth degree felony, whereas existing law classifies this violation as a first degree misdemeanor (Sec. 1).
