Title: Increases Penalties for Failing to Secure a Child in a Car Seat

Vote to pass a bill that increases penalties for failure to secure a child in a passenger restraint system or booster seat.

Highlights:
  • Increases the fine for failing to secure a child in a child passenger restraint system or booster seat from a minimum of $10 and a maximum of $25 to one of the following penalties (Sec. 2):
    • For a first offense, a fine of $100; or
    • For a second or subsequent offense, a fine between $250 and $500.
  • Authorizes the court to waive the fine for a first offense if the defendant provides evidence that he or she possesses a child passenger restraint system (Sec. 2).
  • Establishes the Child Passenger Restraint System Assistance Fund to purchase and distribute child passenger restraint systems (Sec. 3).
  • Requires $25 of each fine to be deposited in the Child Passenger Restraint Assistance Fund (Sec. 2).
