Title: Authorizes Individuals to Record Law Enforcement Officers

Vote to pass a bill that authorizes an individual to record law enforcement officers in public places.

Highlights:

  • Authorizes an individual who is neither a law enforcement officer nor acting at the direction of a law enforcement officer to record the conversation of a law enforcement officer performing a public duty in a public place if the conversation is at a volume “audible to the unassisted ear” of the individual making the recording (Sec. 15).
  • Defines “public place” as any place to which the public has access, including, but not limited to the following (Sec. 15):
    • Streets;
    • Parks;
    • Highways;
    • Inside motor vehicles; or
    • Common areas of public and private facilities and buildings.
  • Specifies that a complainant will be prosecuted by the appropriate State Attorney if he or she submits an intentionally altered recording as evidence of misconduct against a law enforcement officer that inaccurately reflects the incident at issue (Secs. 5 & 10).
