Vote to adopt a conference report that contingently repeals New Hampshire's participation in the Regional Greenhouse Gas Initiative.

Highlights:

  • Authorizes New Hampshire to leave the Regional Greenhouse Gas Initiative (RGGI) and repeal the carbon dioxide cap if either of the following occurs, effective January 1, 2013 (Secs. 11, 17 & 18):
    • If 2 New England states participating in the RGGI end their participation in the initiative; or
    • If 1 New England state that has at least 10 percent of the total energy load of participating New England states ends its participation in the RGGI initiative.
  • Repeals the Greenhouse Gas Emissions Reduction Fund, effective January 1, 2013 (Secs. 4 & 18).
  • Establishes an Energy Efficiency Fund to replace the Greenhouse Gas Emissions Reduction Fund, effective January 1, 2013 (Secs. 4 & 18).
  • Requires auction proceeds in excess of $1 for the sale of a carbon allowance to be allocated as follows, effective January 1, 2013 (Secs. 4 & 18):
    • Rebated to all default service electric ratepayers on a per-kilowatt-hour basis; and
    • Remaining funds to be additional sources of funding for energy efficiency programs that are funded by system benefits charges.
