Title: Requires Proof of Citizenship to Vote
Vote to concur with House amendments and pass a bill that requires a voter to submit an application affirming he or she is a U.S citizen prior to being issued a ballot, effective August 15, 2012.
- Requires a voter to certify he or she is a U.S. citizen prior to being issued a ballot by completing an application that includes the following:
- Name;
- Address of residence;
- Date of birth;
- An affirmative statement indicating that he or she is a citizen of the U.S.; and
- A signature.
- Requires a voter to affirm under oath that he or she is a citizen prior to being issued a ballot if that voter did not state on the application that he or she is a U.S. citizen.
- Prohibits issuing a ballot to an individual who refuses to state that he or she is a U.S. citizen.
- Requires an absent voter ballot application to contain a question asking if the voter is a U.S. citizen.
- Specifies that an absentee ballot will not be counted unless the absentee voter has confirmed on their absent voter ballot application that he or she is a U.S. citizen.
- Authorizes a court, in the case of a contested election, to count an absentee ballot submitted by a voter who did not answer the citizenship question on the voter ballot application, but was a U.S. citizen at the time of the election.
