Title: Requires State Health Laws to Comply with the Affordable Care Act

Vote to pass a bill that requires the state's health laws to comply with the Affordable Care Act.

Highlights:

  • Prohibits health insurance plans beginning on or after January 1, 2014, from excluding individuals with “preexisting conditions,” unless they have the following insurance coverage (Secs. 2, 4, 6, 8, & 10):
    • Disability income;
    • Accident only;
    • Long-term care; and
    • Sickness or bodily injury or death by accident.
  • Defines “preexisting conditions” as a physical or mental condition that was present before the insurance coverage takes effect (Secs. 2, 4, 6, 8, & 10).
  • Prohibits rescinding health insurance coverage once the individual is covered, unless the reason for rescinding coverage is insurance fraud (Secs. 2, 6, 8, & 10).   
  • Prohibits health insurance plans beginning on or after January 1, 2014, from establishing an annual or lifetime coverage limit on essential health benefits, unless the type of insurance plan is one of the following (Secs. 2, 6, & 10):
    • A health flexible spending arrangement; or
    • A health or medical savings account.
  • Prohibits providers from denying individuals health insurance coverage for participating in approved clinical trials (Secs. 2, 6, & 8). 
  • Requires health insurance providers to reserve the following minimum amount of premium payments received for medical care, rather than for other costs or profits (Secs. 2, 6, 8, & 10):
    • 85 percent for large group plans; and
    • 80 percent for small group and individual market plans.
  • Requires health insurance providers who fail to meet the minimum amount of premium dollars that go to medical care to give rebates to the individuals covered (Secs. 2, 6, 8, & 10).
  • Requires health insurance plans to provide coverage for children until they turn 26 years old (Secs. 5 & 7).
  • Requires health insurance plans to provide coverage for a child of any age that is all of the following (Secs. 5 & 7):
    • Not married;
    • Financially dependent on the parent; and
    • Medically determined to have a physical or mental impairment that is expected to either result in death or the impairment is expected to last for at least 12 months.
