Title: Requires Manufactured Home Community Owners to Explain Rent Increases
Vote to pass a bill that requires manufactured home community owners to explain rent increases greater than the Consumer Price Index For All Urban Consumers (CPI-U).
- Prohibits owners of manufactured home communities from raising the average rent in any amount more than the Consumer Price Index For All Urban Consumers (CPI-U) of the previous year unless the owner is able to demonstrate that the cost of improving, operating, and maintaining the community has risen more than the CPI-U (Sec. 2).
- Requires an owner of a manufactured home community wishing to raise the average rent by more than the CPI-U to apply for the increase to the Council on Manufactured Housing (Sec. 2).
- Authorizes a representative of a homeowner's organization for an affected community to supply evidence to the Council regarding the rent increase request of the owner (Sec. 2).
- Authorizes a homeowner's organization representing an affected community, or the owner of an affected community, to appeal a decision of the Council on Manufactured Housing to the Superior Court in the county of residence within 30 days of the Council's decision (Sec. 2).
- Specifies that owners of manufactured home communities who raise rent more than the CPI-U of the previous calendar year without approval from the Council on Manufactured Housing are subject to forfeiting 3 to 6 months of rent from each home owner in the affected community (Sec. 2).
