Vote to adopt a conference report proposing a constitutional amendment to prohibit the taking of land by eminent domain for other than actual public purpose. The bill specifically prohibits the taking of land by eminent domain for purposes of raising revenue or creating jobs. The bill also prohibits the taking of a non-blighted property located in a blighted area. The bill also specifies that eminent domain can still be used by the Alabama State Port Authority in the city of Mobile, by the state or political subdivisions for various public purposes and airport authorities if a project has been invested in by the Legislature.

Vote Smart's Synopsis:

Vote to pass a bill proposing a constitutional amendment that prohibits the taking of land by eminent domain for other than actual public purpose. The bill specifically prohibits the taking of land by eminent domain for purposes of raising revenue or creating jobs. The bill also prohibits the taking of a non-blighted property located in a blighted area and allows fifteen years for the public agency to convert the property to a public purpose. Otherwise, the original owner may repurchase the condemned property from the public agency. Additionally, the bill provides compensation to an owner of blighted property and this property cannot be taken without the owners consent unless it is approved by a court of law. If any property is to be taken by eminent domain it is to "be valued at its highest and best use."
