  • Requires all school districts and all non-public, non-sectarian elementary and secondary schools to create and implement a policy on “bullying” which must be updated every 2 years with the State Board of Education (Sec. 5).

    • Places the student in fear of harm;
    • Causes a “detrimental effect” on a student's physical or mental health;

  • Defines a “policy on bullying” as a bullying prevention policy that includes, but is not limited to, the following (Sec. 5):
    • The definition of bullying;
    • A statement indicating that bullying is a violation of state law and school district policy;
    • Procedures for reporting, investigating and addressing bullying; and
    • Interventions that can be taken to address bullying.

A MAJORITY OF THE TOTAL MEMBERS IN THE LEGISLATIVE BODY IS REQUIRED TO PASS A BILL: 60 MEMBERS OF THE ASSEMBLY AND 30 MEMBERS OF THE SENATE.
