Highlights:

• Requires the Alabama Department of Homeland Security to publish on its public website a report identifying undocumented immigrants who appeared in court for any violation of state law (Sec. 5). 

• Prohibits undocumented immigrants from enrolling or attending public postsecondary education institutions (Sec. 1). 

• Authorizes a public postsecondary education institution officer to seek federal verification of an undocumented immigrant's immigration status (Sec. 1). 

• Authorizes an individual to demonstrate United States citizenship through voter registration forms (Sec. 2).

• Requires businesses in contract with the state to enroll in the “E-verify” program operated by the United States Department of Homeland Security in order to verify every employee's legal authorization to work in the United States (Sec. 1). 

• Requires an employer that employs an undocumented immigrant to be subject to the following upon first violation (Sec. 1):
• Termination of the business's contract with the state;
• Termination of all undocumented immigrants; 
• Probation up to 3 years, requiring the business to file a quarterly report including each newly hired employee; and
• Suspension of the business's permit or license for no more than 60 days.

• Requires an employer that employs an undocumented immigrant to be subject to the following upon the second violation within 10 years of the first violation (Sec. 1):
• Termination of the business's contract with the state; 
• Termination of all undocumented immigrants; 
• Probation for up to 5 years, requiring the business to file a quarterly report including each newly hired employee; and
• Suspension of the business's permit or license for no less than 60 days and no more than 120 days. 

• Requires an employer that employs an undocumented immigrant to be subject to the following upon the third violation (Sec. 1):
• Termination of the business's contract with the state; 
• Termination of all undocumented immigrants; and
• Permanent revocation of the business's permit or license. 

• Classifies facilitating or attempting to facilitate 5 or more undocumented immigrants as a Class C felony (Sec. 2).

Vote to pass a bill that amends immigration laws.

Highlights:

• Requires verification of lawful presence in the United States for the first issuance of any commercial or professional license, if the issuance is considered a “state or local public benefit” (Sec. 1).

• Specifies that a contractor can be held liable if it is shown that the contractor had direct knowledge that a subcontractor had knowingly hired or was knowingly hiring undocumented immigrants in the state of Alabama (Sec. 1).

• Requires a court to do all of the following if an employer is found to knowingly employ an undocumented immigrant in the state of Alabama (Sec. 1):
• Order the employer to terminate the employment of every undocumented immigrant;
• Subject the employer to a 3 year probationary period where he or she is required to file quarterly reports of every new hire; and
• Order the employer to file a signed, sworn affidavit within 3 days, stating that he or she has terminated the employment of every undocumented immigrant.

• Requires a court to suspend business licenses or any other authorizing documents of an employer if he or she is found to knowingly hire undocumented immigrants in the following manner, unless the court determines that the suspension is not in the best interest of the public (Sec. 1):
• 60 day suspension for the first infraction;
• 120 day suspension for the second infraction; and
• Permanent suspension for the third infraction.

• Requires the Department of Education to determine the total annual fiscal impact on the state for providing public educational services to children of undocumented immigrants (Sec. 3).
