Title: Limits the Number of Foreign Nationals that May Work in a Charter School

Vote to pass a bill that limits the number of foreign nationals that may work at charter schools, effective July 1, 2012.

Highlights:
  • Prohibits a chartering authority from approving a charter school application if any of the following apply (Sec. 3):
    • The number of foreign nationals on H1B or J1 visa programs working in a charter school exceeds 3.5 percent of the school's staff;
    • The governing body or sponsor has been affiliated with a charter school that has done one of the following:
      • Been investigated for questionable use of foreign national visa programs; or
      • Used more than 2 foreign national recruits in a school year;
    • The governing body or sponsor intends to or is attempting to avoid affiliation with foreign national visa programs by affiliating with higher education programs that are exempted from the visa program's annual caps; or
    • The governing body or sponsor of the proposed charter school is controlled by foreign nationals.
  • Requires charter schools to seek approval from the chartering authority before hiring a foreign national  seeking an alternative licensure, an H1B or a J1 non-immigrant visa, and must demonstrate failed attempts to find a U.S. permanent resident for the position (Sec 4).
  • Requires charter school applications to disclose any funding from foreign sources (Sec 2.).
  • Prohibits charter schools from contracting with foreign national individuals or entities for goods or services (Sec. 5).
