Title: Repeals Certain Public Benefits for Undocumented Immigrants

Vote to pass a bill that prohibits undocumented immigrants from attending state universities or colleges, effective July 1, 2012.

Highlights:

  • Prohibits undocumented immigrants from attending state universities or colleges without verification of immigration status (Sec. 1).
  • Authorizes applicants for public benefits that require verification of immigration status to verify the status by (Secs. 1 & 2):
    • Signing an affidavit specifying the applicant is 18 years of age or older and is:
      • A United States citizen or permanent resident; or
      • Authorized alien or nonimmigrant;
    • If the applicant is under 18 years of age:
      • Signing an affidavit within 30 days after the applicant's 18th birthday; and
    • Providing valid documentation within 9 months prior to the application deadline which includes the following:
      • An unexpired identification issued by a state or federal jurisdiction or federally recognized jurisdiction; or
      • A foreign passport that is submitted with a valid United States Homeland Security Form I-94 or I-94A.
  • Exempts applicants renewing applications for a public benefit from the provisions that require the applicant to submit documentation establishing U.S citizenship (Sec. 1).
