Vote to pass a bill that authorizes random drug testing of state employees.

Highlights:

  • Authorizes a state employer to conduct random drug tests of up to 10 percent of the total employee population no more than once every 3 months (Sec. 1).
  • Authorizes a state employer upon a first-time confirmed positive drug test result to take either of the following actions (Sec. 1):
    • Dismiss or discipline the employee; or
    • Refer the employee to an alcohol and drug rehabilitation program or employee assistance program at the expense of the employee.
  • Prohibits employees participating in an alcohol and drug rehabilitation program or employee assistance program from being placed in “mandatory testing” positions which include, but are not limited to, the following jobs (Sec. 1):
    • Carrying a firearm or working with an individual that carries a firearm;
    • Performing life-threatening actions;
    • Performing safety inspections; or
    • Working with any of the following:
      • Heavy machinery;
      • Confidential information;
      • Controlled substances;
      • Children; or
      • Detainees in a correctional facility.
