Title: Limiting Manufacturer Eligibility for Punitive Damages

Vote to pass a bill that limits the circumstances in which an individual may sue manufacturers, service providers, or sellers for punitive damages.

Highlights:
  • Prohibits any individual from suing a manufacturer, service provider, or seller for punitive damages if (Sec. 1):
    • The product was designed, manufactured, and sold in accordance with the regulations of a government agency;
    • The product, activity, or service was in compliance with state and federal laws at the time it left the control of the manufacturer or seller; and
    • The terms of service or contract provisions comply with the rules, regulations, or statutes of a government agency.
  • Exempts individuals who can prove that the manufacturer, service provider, or seller did any of the following (Sec. 1):
    • Deliberately sold the product, activity, or service after its expiration date or after an approval withdrawal from a government agency;
    • Intentionally violated government regulations or withdrew or misrepresented information regarding the approval of a product, activity, or service, to a government agency;
    • Illegally paid an official or employee of a government agency for the purpose of securing or maintaining approval of the product, activity, or service; or
    • Knowingly violated applicable regulations requiring the reporting of product risks.
  • Specifies that this bill does not expand the authority of state agencies to adopt new standards or regulations (Sec. 1).
