Vote to pass a bill that prohibits traffic checkpoints.

Highlights:

• Prohibits all law enforcement agencies, including state, local, and college or university law enforcement agencies, from conducting administrative traffic checkpoints (Sec. 2).

• Defines “administrative traffic checkpoint” as a roadblock procedure where enforcement officers stop all, or a designated sequence of, motor vehicles traveling on highways and roads and subject those vehicles to inspection or testing and the drivers or occupants to questioning or the production of documents (Sec. 1).

• Authorizes law enforcement officers to stop motor vehicles and detain the occupants if the officer (Sec. 3):
• Is acting pursuant to an authorized search warrant or arrest warrant;
• Has probable cause to arrest or search;
• Has reasonable suspicion that criminal activity has occurred or is occurring;
• Is acting under emergency circumstances; or
• Is acting pursuant to an authorized administrative traffic checkpoint authority granted by a magistrate.
