Title: Authorizes Kansas to Determine Its Health Care Policies
Vote to pass a resolution that submits a constitutional amendment to voters that prohibits the citizens of Kansas from being required to purchase health insurance.
- Prohibits the law from requiring any individual, employer, or health care provider to participate in any health care system or purchase health insurance (Sec. 1).
- Prohibits fines that include, but are not limited to, the following (Sec. 1):
- An individual or employer paying directly for health care services; or
- A health care provider accepting direct payment for health care services.
- Specifies that this resolution to amend the state constitution will be voted on during the next general election unless the United States Supreme Court upholds the “Patient Protection and Affordable Health Care Act” before September 1, 2012 (Secs. 1 & 3).
NOTE: AN AMENDMENT TO THE CONSTITUTION REQUIRES TWO-THIRDS APPROVAL IN EACH CHAMBER FOR PASSAGE. IT MUST THEN BE APPROVED BY A MAJORITY OF CITIZENS VOTING IN THE NEXT ELECTION TO BECOME EFFECTIVE.
