Title: Increases Penalties for Public Officials who Commit Crimes

Vote to pass a bill that increases penalties for corruption offenses by public servants.

Highlights:

  • Prohibits public servants convicted of a felony offense from acting as lobbyists or working under contract for any public entity, including, but not limited to any state department, agency or political subdivision (Secs. 5-12).
  • Increases the penalty by one year for public servants convicted of, but not limited to, the following offenses (Secs. 5-12):
    • Embezzlement;
    • Paying or receiving public money for services not rendered;
    • Intentionally creating false public vouchers; 
    • Accepting anything of value from a supplier or purchaser of goods or services to the state; or
    • Bribery.
  • Authorizes the forfeiture of a public pension if a current or former public servant is (Sec. 14):
    • Prosecuted for a public corruption offense in criminal court; and 
    • The offense is related to their public work or position.
  • Defines public servant as any person elected or appointed to a position within the state, any of its departments, agencies, institutions or political subdivisions (Sec. 5).
  • Requires all state agencies and institutions to post a list of public corruption offenses and the associated penalties (Sec. 13).
  • Effective July 1, 2012 (Sec. 15).
