Title: Drug and Alcohol Testing for Legislators
Vote to adopt an amendment to HB 1007 that requires legislators to consent to annual drug and alcohol testing.
- Requires legislators to be administered an annual drug test and a randomly administered breath test to determine alcohol concentration levels beginning June 30, 2012.
- Specifies that a legislator may be disciplined or assessed a penalty if they:
- Refuse to consent to a drug or alcohol test;
- Test positive on a drug test; or
- Receive an alcohol concentration level on a breath test that is greater than the amount allowed while driving in Indiana.
- Prohibits the use of the legislative council’s records from a drug or breath test as evidence against a defendant in a criminal trial.
