Vote to concur with House amendments and pass a bill that prohibits partial birth/late-term abortions unless the abortion procedure is necessary to save the life of the mother, effective January 1, 2012.

Highlights:
-Prohibits partial birth/late-term abortions and specifies that any person who knowingly performs a partial birth/late-term abortion is guilty of a felony punishable by imprisonment for no more than 2 years, a fine of no more than $50,000, or both (Sec. 2). -Defines a "partial-birth abortion" as an abortion in which a physician or any other individual performing an abortion deliberately and intentionally vaginally delivers a living fetus until, in the case of a headfirst presentation, the entire fetal head is outside the body of the mother or, in the case of a breech presentation, any part of the fetal trunk past the naval is outside the body of the mother, for the purpose of performing an overt act, other than completion of delivery, that kills the partially delivered living fetus (Sec. 9). -Authorizes partial-birth/late-term abortions that are necessary to save the life of a mother whose life is endangered by a physical disorder, physical illness, or physical injury (Sec. 3). -Specifies that a woman seeking a partial birth/late-term abortion is not a conspirator to commit a violation of this act (Sec. 5). -This act is effective January 1, 2012 (Sec. 1).

-Defines "partial birth abortion" as an abortion in which the physician, or individual working under the physician, deliberately delivers the fetus until the entire fetal head is outside the body of the mother in a headfirst case, or any part of the fetal trunk past the naval is outside the mothers body in a breech presentation case, for the purpose of performing an abortion (Sec. 1). -Authorizes partial birth/late-term abortions in cases where a physician determines that the abortion is necessary to save the life of a woman who is endangered by a physical disorder, illness, or injury (Sec. 1). -Specifies that an individual who is not a physician or an individual who otherwise illegally performs a partial birth/late term abortion is guilty of a felony punishable by imprisonment for not more than 2 years, or a fine of not more than $50,000, or both (Sec. 1). -Specifies that the spouse of the pregnant women, or either parent of the woman if the woman is under the age of 18, at the time of the partial birth/late-term abortion may file a civil action against the physician or individual and may recover the following (Sec. 4):
    -Actual damages including damages for emotional distress and; -Treble damages for the cost of the partial birth/late-term abortion.
