-Authorizes the governing body of a high-performing nonpublic school in a failing school district to submit an application to the Commissioner of Education to convert the school into a charter school, whereas existing law prohibited private and parochial from being eligible for charter school status (Secs. 1 & 2). -Defines a "failing school district" as a school district in need of improvement under the provisions of the No Child Left Behind Act (Sec. 1). -Defines "high-performing nonpublic school" as a school that ranked in the 66 percentile or higher in school achievement testing in the previous year (Sec. 1).
