Title: DNA Samples for Felony Charges

Vote Smart's Synopsis:

Vote to pass a bill that requires any person arrested for a felony or sexual offense to submit to a DNA test.

Highlights:

  • Requires a law enforcement agency making an arrest for a felony pursuant to a warrant to do the following (Sec 3):
    • Submit the name, social security number, date of birth and any other information identifying the person to the Central Repository for Nevada Records of Criminal History; and
    • Obtain a biological specimen from the person through a cheek swab before the person is released from custody.
  • Specifies that if a person is arrested for a felony without a warrant the arrested agency shall obtain a biological sample; however, the arresting agency shall not submit the sample for testing until a court or magistrate has determined probable cause existed for the person's arrest (Sec 3).
  • Authorizes any individual whose biological sample has been taken to submit a request that it be expunged if their charge or conviction has been reversed and dismissed (Sec. 3).
  • Specifies there be a $2.50 charge added to the sentence fee for any person convicted of a misdemeanor, gross misdemeanor or felony for the DNA test (Sec 2).
