Vote to concur with Senate amendments and pass a bill that repeals certain standards for cigar bar ventilation systems and establishes criteria for smoke shop certification with the Oregon Health Authority.

Highlights:
-Requires cigar bars to have a ventilation system that exhausts smoke from the business and is designed in accordance with state building code standards, whereas existing law required ventilation systems to be certified by the assistant to the State Fire Marshal as adequate to remove smoke from the bar and prevent it from entering any other establishment (Sec. 1). -Requires a smoke shop to be certified as a smoke shop with the Oregon Health Authority (Sec. 1). -Authorizes the Oregon Health Authority to issue smoke shop certifications to businesses that (Sec. 3):
    -Are primarily engaged in the sale of tobacco products and smoking instruments intended for off-premises consumption or use, with at least 75 percent of the gross revenues of the business resulting from such sales; -Prohibit individuals less than 18 years of age from entering the premises; -Do not offer video lottery games, social gaming, or betting on the premises; -Do not sell, offer or allow on-premises consumption of food or beverages, including alcoholic beverages; -Are stand-alone businesses with no other business or residential property attached to the premises; -Have a maximum seating capacity of 4 persons; and -Allow smoking only for the purpose of sampling tobacco products in order to make retail purchase decisions.
-Requires a smoke shop to renew its certification every 5 years (Sec. 3).
