Title: Remediation for Oil and Gas Sites

Vote to pass a bill that requires the party filing or amending a lawsuit based on environmental damage to an oilfield or exploration and production sites must immediately notify the Department of Natural Resources, Commissioner of Conservation, and Attorney General before judgment or order can be granted or litigation dismissed, and stays litigation for 30 days after notification is made and return receipt filed. The bill requires the court to order the party responsible for damage to develop a plan to evaluate or remediate damage that includes cost estimate, and also requires, after review and public hearing, that the department approve or structure a plan, which is not subject to court review, and unless a party proves another more feasible, the court is to adopt it and order the responsible party to deposit funds to pay for it.
