Title: Requires Verification of Citizenship for Certain Benefits

Vote to pass a bill that requires verification of citizenship or verification of a qualified immigration status for certain benefits.

Highlights:

  • Prohibits the district board of accredited community colleges and public universities from admitting a student unless the student provides documentation proving lawful presence in the United States including, but not limited to, the following (Sec. 7):
    • An Arizona driver license or an Arizona identification card;
    • A birth certificate issued in any state, territory or possession of the U.S.;
    • A U.S. certificate of birth abroad;
    • A U.S. Passport; or
    • A foreign passport with a United States visa.
  • Requires schools or school districts to notify in writing the parent or guardian enrolling their child in a school that they must provide within 30 days documentation proving the lawful presence of their child in the United States including, but not limited to, the following (Sec. 6):
    • A birth certificate issued in any state, territory or possession of the U.S.;
    • A U.S. certificate of birth abroad;
    • A U.S. Passport; or
    • A foreign passport with a United States visa.
  • Requires every employer, after hiring an employee, to verify the employment eligibility of the employee through the e-verify program (Sec. 9).
  • Requires an applicant for a vehicle title to provide proof that his or her presence in the country is authorized under federal law (Sec. 11).
  • Classifies knowingly using another individual's personal identifying information to obtain employment as a Class 3 felony punishable by at least 180 days in county jail (Sec. 3).
  • Classifies the operation of a motor vehicle by an undocumented immigrant as a Class 1 misdemeanor (Sec. 4).  
  • Prohibits individuals who do not have verification of United States citizenship or verification of a qualified immigration status from living in public housing and any violation of this provision is a Class 1 misdemeanor (Sec. 17).
  • Prohibits agencies or political subdivisions of the state from issuing a license to an individual that does not provide verification of United States citizenship or verification of a qualified immigration status including any of the following (Sec. 18):
    • An agency permit;
    • A certificate;
    • An approval;
    • A registration;
    • A charter; or
    • A similar form of authorization that is required by law and that is issued by any state agency.
