Title: Reduce Punishment for Drug Possession

Vote to pass a bill that amends existing statues concerning the sale and possession of illegal drugs.

Highlights:

  • Authorizes courts, when determining whether the public health, safety, or welfare immediately requires a temporary abatement order to consider if the site alleged to be a nuisance or location of illegal drug activity is located within a protected park, recreation area, church, synagogue, or place of worship (Sec. 2).
  • Prohibits any person from purchasing, owning, possessing or controlling a deadly weapon or ammunition for a fireman that possesses a controlled substance and if the deadly weapon is a semi-automatic or automatic firearm, or a handgun (Sec. 5).
  • Specifies that the illegal delivery of prescription drugs shall be considered a violent felony (Sec. 10).
  • Describes a quantity tier system for the quantity of controlled substances, and defines the tiers with regards to the amount of controlled substances necessary to constitute being in that tier (Sec. 35).
  • Describes what constitutes felonies, from Class B to Class F felonies (Secs. 38-54).
