Title: Prohibits Employment of Undocumented Immigrants

Vote to pass a bill that prohibits the employment of undocumented immigrants.

Highlights:
  • Prohibits any person, employer, or business entity from knowingly and intentionally employing undocumented immigrants to perform work within the state of South Dakota (Sec. 1).
  • Specifies that employers can defend themselves against possible violations of this act by confirming the legal work status of applicants through the E-verify program or through completion of I-9 forms, and retaining documentation of work status verification (Sec. 3).
  • Establishes penalties for violations of this act as follows (Sec. 5):
    • The first violation is punishable by a civil fine of no more than $1,000, regardless of the number of undocumented immigrants employed by the violator;
    • The second violation is guilty of a Class 2 misdemeanor; and
    • All subsequent violations constitute a separate offense with respect to each undocumented immigrant.
