Title: Labor Organizations

Vote to pass a bill that prohibits funds collected by labor organizations from being used to compensate contractors or subcontractors.

Highlights:

  • Prohibits a contractor or subcontractor from directly or indirectly receiving payments drawn from dues or assessments collected by a labor organization (Sec. 1).
  • Prohibits labor organizations from directly or indirectly paying a wage subsidy or wage rebate to its members in order to directly or indirectly subsidize a contractor or subcontractor (Sec. 1).
  • Prohibits anyone from using any fund financed by wages collected by, or on behalf of, a labor organization to subsidize a contractor or subcontractor doing business in the state of Idaho (Sec. 1).
  • Specifies that any contractor, subcontractor or labor organization that violates the above provisions shall be guilty of a misdemeanor and fined as follows (Sec. 1):
    • No more than $10,000 for a first offense;
    • $25,000 for a second offense; and
    • $100,000 for each and every additional offense.
  • Authorizes any interested party to challenge any bid, award, grant, or cooperative agreement that violates this act, and that such interested party shall be awarded costs and attorney's fees if he or she prevails (Sec. 1).
