Title: Collective Bargaining Rights for Public Employees
Vote to adopt a conference report that limits collective bargaining rights for public employees.
- Authorizes general employees, except public safety employees in a fair-share agreement, to refrain from paying dues and still remain a member of the collective bargaining unit (Sec. 219).
- Prohibits municipal employers from deducting labor organization dues from the earnings of a public safety employee without an order signed by the employee and terminable within 30 days of the written notice of the employee, except when a fair-share agreement is in effect (Sec. 223).
- Prohibits municipal employers from deducting labor organization dues from the earnings of a general municipal employee (Sec. 227).
- Prohibits municipal employers from bargaining collectively with a collective bargaining unit containing a municipal employee with respect to any of the following (Sec. 245):
- Any factor or condition of employment except wages, which includes only total base wages and excludes any other compensation; and
- Any proposal that does the following:
- If there is an increase in the consumer price index change, provides for total base wages that exceed the total base wages for authorized positions 180 days before the expiration of the previous collective bargaining agreement by a greater percentage than the consumer price index change; or
- If there is a decrease in the consumer price index change, provides for total base wages that exceed the total base wages for authorized positions 180 days before the expiration of the previous collective bargaining agreement decreased by a percentage of that expenditure that is equal to the decrease in the consumer price index change.
- Requires representatives of collective bargaining units that contain general employees to be certified by 51 percent of the votes of all the general employees in the collective bargaining unit in annual elections (Sec. 242).
- Specifies that if no representative receives at least 51 percent of the votes, then the general employees shall not be represented (Sec. 242).
- Prohibits employers from offering health care coverage plans to their employees if the employer pays more than 88 percent of the average premium cost of plans (Sec. 88).
