Vote to pass a bill that exempts certain agricultural producers selling products directly to the general public from state laws regulating produce dealers and food establishments.

Highlights:

• Exempts farm direct marketers from inspection fees for agricultural products and produce dealers license fees (Sec. 2).

• Specifies that exemptions apply to farm direct marketer sales of the following types of agricultural products (Sec. 2):
• Fresh fruit, vegetables and herbs;
• Fruit, vegetables and herbs, if those items are cured or dried by the agricultural producer as part of routine post-harvest handling;
• Shelled nuts and unshelled nuts, if those items are cured or dried by the agricultural producer as part of routine post-harvest handling; 
• Other products identified by the department by rule.

• Specifies that exemptions apply to the consignment sales of the following types of agricultural products (Sec. 2):
• Fresh fruits, vegetables and herbs;
• Fruit, vegetables and herbs, if those items are cured or dried by the agricultural producer as part of routine post-harvest handling;
• Unshelled nuts that are cured or dried by the agricultural producer as part of routine post-harvest handling;
• Shell eggs;
• Honey, if not combined with other food ingredients; and
• Other products identified by the department by rule.

• Defines "consignment" as an agreement under which an agricultural producer sells to the retail purchaser the agricultural products of another agricultural producer that is located in the same county as the agricultural producer, or in any county adjoining a county in which the agricultural producer is located, without representing that the products were grown or raised by the seller (Sec. 1).

• Specifies that exemptions do not apply to foods that have been mixed, pooled or otherwise combined with the agricultural products of more than one producer prior to the sale of the products (Sec. 2).
