Title: Authorizing Governor Recall Elections

Vote to pass a Joint Resolution that submits a constitutional amendment to the voters that authorizes gubernatorial recall elections initiated by petition.

Highlights:

-Authorizes the initiation of an election to recall the Governor by petition with signatures at least equal in number to 15 percent of total votes cast in the preceding gubernatorial election, with at least 100 signatures from at least 25 separate counties, and with the requisite signatures being collected within 150 days of the filing of an affidavit with the State Board of Elections (Sec. 7). -Prohibits an affidavit for the recall of the Governor from being filed sooner than 6 months after the beginning of the Governor's term (Sec. 7). -Requires the affidavit to be signed by at least 20 members of the state House of Representatives and at least 10 members of the state Senate, with no more than half of the signatures from each chamber belonging to members of the same established political party (Sec.7). -Prohibits another recall petition from being initiated during the remainder of the Governor's term after the State Board of Elections has certified one petition for the Governor's recall (Sec.7). -Requires that the Governor be removed immediately upon certification of the election results if a majority of voters vote for recall, and specifies that in such case the Governor shall be succeeded by an Acting Governor until a candidate is elected in the special successor election to serve the rest of the recalled Governor's term (Sec.7).

NOTE: AN AMENDMENT TO THE CONSTITUTION REQUIRES THREE-FIFTHS APPROVAL IN EACH CHAMBER FOR PASSAGE. IT MUST THEN BE APPROVED BY A MAJORITY OF CITIZENS VOTING IN THE NEXT ELECTION TO BECOME ENACTED.
