Title: Labor Standards for Domestic Workers
Vote Smart's Synopsis:
Vote to pass a bill that establishes industry-specific protections and labor standards for domestic workers.
-Defines a "domestic worker" as a person employed in a home or residence for the purpose of caring for a child, serving as a companion to a sick, convalescing or elderly person, housekeeping, or for any other domestic service purpose (Sec. 2).
-Prohibits domestic workers from being required to work more than 8 hours in a day and establishes that overtime work shall be paid at a rate that is at least one and one-half times the worker's normal hourly rate (Sec. 2).
-Requires domestic workers to have at least 24 consecutive hours of rest each week and that work performed during that time is considered overtime (Sec. 2).
-Specifies that if the domestic worker works at least 20 hours a week, they are entitled to paid time off on New Year's Day, Martin Luther King Jr.'s Birthday, Independence Day, Thanksgiving, Labor Day, and Christmas Day (Sec. 2).
-Specifies that when the worker's schedule is at least 40 hours a week, they are entitled to 7 days of paid time off for sick leave and 5 days of paid time off for vacation each year (Sec. 2).
-Specifies that when the worker's schedule is at least 20 but less than 40 hours a week, they are entitled to 3 days of paid time off for vacation each year (Sec. 2).
-Requires the employer to provide the domestic worker with a written notice of termination 14 days prior to his/her final day of employment unless the worker is fired for causes such as theft or destruction of property (Sec. 2).
-Authorizes the domestic worker to recover from underpayments of wages in a civil action (Sec. 2).
