Title: Requiring Women Seeking Abortions to Answer Questionnaire

Vote to pass a bill requiring physicians to complete a specific form when performing an abortion or when discovering a medical complication caused by a past abortion and requiring the State Department of Health to produce reports with the data thus obtained.

Highlights:
-Requires the State Department of Health to make available on its website by March, 1, 2012, the Individual Abortion Form, the Complications of Induced Abortion Report and the regulations concerning abortion (Sec. 2). -Requires physicians performing abortions to submit electronically an Individual Abortion Form to the State Department of Health for each abortion performed, by the last business day of the month following the month during which the abortion took place (Sec. 3). -Requires physicians to make women getting an abortion in their clinic to fill out an anonymous Individual Abortion Form, which includes, but is not limited to, the following questions (Sec. 3):
    -The date and the county where the abortion was performed; -Information regarding the woman having aborted: age, marital status, race, level of education, state or foreign country of residence, previous pregnancies; -The approximate gestational age of the embryo/fetus; -The method that was used to perform the abortion; -Whether the abortion failed and led to the birth of an infant, and if yes, whether measures to keep him alive were undertaken and how long the child survived; -The reasons given by the woman for having had an abortion; -Whether ultrasound equipment was used before,during, and after the procedure; -Whether the woman seeking an abortion has been provided the information required by law; -In case the woman having aborted was a minor: her age, the age of the father of the fetus, whether one of her parents was notified, whether the informed written consent of one of them was obtained, and if no, by which means was the minor legally able to get an abortion; -The date at which the form was completed; and -The name and license number of the physician.
-Requires any physician encountering a medical problem related to a past abortion to submit electronically a Complications of Induced Abortion Report to the State Department, completed by an anonymous patient, within sixty days, containing the following information (Sec. 4):
    -The name, address and telephone number of the health facility where the complication was discovered; -The date on which the complication was discovered; -The health facility where the abortion was performed as well as the date of the procedure; -The age of the patient; -The nature of the complication; and -The name and license number of the physician.
-Requires the State Department of Health to produce an Annual Abortion Report compiling the data obtained through the collection of both the Individual Abortion Form and the Complications of Induced Abortion Report, and to put the Abortion Report on its website, including the results of the previous Abortion Reports, by June 1 of each year (Sec. 5). -Requires the State Department of Health every year to produce a Judicial Bypass of Abortion Parental Consent Summary Report compiling part of the data obtained in the "'minor section'' of the Individual Abortion Forms collected, and to put it on its website, including the results of the previous reports (Sec. 5). -Establishes a fine of $500 for each 30 day period in which either the Individual Abortion Form or the Complications of Induced Abortion Report is not reported on time (Sec. 6). -Makes failure to submit either of these two forms or submission of false information a misdemeanor (Sec. 6). -Requires the State Department of Health, the State Board of Medical Licensure and Supervision as well as the State Board of Osteopathic Examiners to conduct periodic inspections in order to verify the exactness of the information reported by physicians (Sec. 6). -Specifies that if any part of this bill is declared unconstitutional, its other provisions shall remain in effect as long as they themselves are not struck down (Sec. 10).
