Title: Prohibiting Gender Identity Discrimination

Highlights:

-Defines "gender identity or expression" as having or being perceived as having a gender identity, self-image, appearance, behavior, or expression, regardless whether or not that gender identity, self-image, appearance, behavior, or expression is different from that traditionally associated with the sex assigned to that individual at birth (Sec. 3). -Prohibits employers, licensing agencies, or employment agencies from refusing to hire or employ, barring or discharging from employment, or discriminating in compensation, terms, conditions, or privileges of employment based on gender identity or expression (Sec. 5). -Prohibits labor organizations from excluding or expelling from membership, or discrimination in any way against members, employers, or employees based on gender identity or expression (Sec. 5). -Prohibits guidance programs, apprenticeship training programs, on-the-job training programs, executive training programs, or other occupational training or retraining programs from denying, discriminating against a individual's pursuit of, or withholding the right to be admitted to or participate in such a program based on gender identity or expression (Sec. 6). -Prohibits discrimination on the part of any individual who is a representative of any place of public accommodation, resort, or amusement toward any individual on the basis of gender identity or expression (Sec. 7). -Prohibits discrimination on the part of any individual selling, renting, or leasing housing accommodation, including publicly assisted housing accommodations, based on gender identity or expression (Sec. 8). -Prohibits non-sectarian, tax exempt education corporations or associations from denying the use of its facilities to any individual otherwise qualified, or to permit the harassment of any student or applicant, based on gender identity or expression (Sec. 10). -Prohibits real estate boards from excluding or expelling an individual from membership who is otherwise qualified, or to discriminate against such individual in the terms, conditions, and privileges of membership in such board based on gender identity or expression (Sec. 11). -Prohibits fire departments or fire companies therein from denying to any individual membership in any volunteer fire department or fire company therein, or expelling or discriminating against any volunteer member of a fire department or fire company therein based on gender identity or expression (Sec. 12). -Prohibits discriminating against, boycotting or blacklisting, or refusing to buy from, sell to, or trade with, any individual or such individual's partners, members, stockholders, directors, officers, managers, superintendents, agents, employees, business associates, suppliers or customers based on gender identity or expression (Sec. 13). -Prohibits creditors or officers, agents, or employees thereof from doing the following based on gender identity or expression (Sec. 14):

    -In the case of applications for credit with respect to the purchase, acquisition, construction, rehabilitation, repair, or maintenance of any housing accommodation, land, or commercial space, discriminating against any such applicant or any member, stockholder, director, officer, or employee of such applicant or applicants, or of the prospective occupants or tenants of such housing accommodation, land, or commercial space, in the granting, withholding, extending, or renewing, or in the fixing of the rates, terms or conditions of, any such credit; -Discriminating in the granting, withholding, extending or renewing, or in the fixing of the rates, terms, or conditions of, any form of credit; -Using any form of application for credit or use or make any record or inquiry which expresses, directly or indirectly, any limitation, specification, or discrimination; -Making any inquiry of an applicant concerning his or her capacity to reproduce, or his or her use or advocacy of any form of birth control or family planning; or -Refusing to consider sources of an applicant's income or to subject an applicant's income to discounting, in whole or in part.
-Prohibits considering aggregate statistics or assumptions about gender identity or expression in evaluating the credit worthiness of an applicant (Sec. 14). -Prohibits educational institutions from discriminating against any student or prospective student who is otherwise qualified, with respect to admissions, educational programs, and courses operated or provided by such institution, based on gender identity or expression (Secs. 16-17). -Expands the definition of "hate crime" to include crimes where the perpetrator intentionally selects to commit an offense against a person based on that person's gender identity or expression (Sec. 19).
