Title: Smoking Ban Bill

Vote to adopt a conference report that prohibits smoking in public places including airports, bars, bowling alleys, health care facilities, night clubs, restaurants, places of employment, sports arenas and stadiums, and all enclosed or partially enclosed areas owned, leased or operated by the state. Smoking is also prohibited twenty feet from entrances, exits, open windows and ventilation intakes in enclosed public places. Private residences, hotel rooms that are designated smoking rooms, tobacco shops, long term care facility private and semi-private rooms, outdoor places of employment and film production sets are exempt from these provisions. A person is subject to a fine of $50 if found smoking in a designated non-smoking area. A person who owns, operates or manages a facility that fails to follow these provisions is subject to a $100 fine for the first violation, $200 for the second violation within one year and $500 for each subsequent violation. The sale of cigarettes is also prohibited from a lunch wagon within one thousand feet of any public or private school grounds, and cigarette vending machines unless the machine is located in a bar or other establishment where the patron minimum age is 18.
