Title: Marijuana Decriminalization

Vote Smart's Synopsis:

Vote to pass a bill that decriminalizes the possession of 1/4 ounce or less of marijuana beginning January 1, 2011.

Highlights:

  • Reduces the classification of crime and penalties for the possession of 1/4 ounce or less of marijuana as follows (Sec.1):
    • Existing law: Class A misdemeanor punishable by a up to 1 year imprisonment, a fine of up to $2,000, or both; and 
    • New law:
      • For individuals 18 years of age or older, a violation punishable by a fine of up to $200;
      • For individuals under 18 years of age, a violation punishable by the following:
        • Fine of up to $200; 
        • Notification of parents or legal guardians; 
        • Required to complete an approved drug awareness program within 1 year of the date of the offense; and 
        • Required to participate in community service to be completed within 1 year of the date of the offense.
  • Increases the fine for individuals under 18 years of age to up to $1,000 if the individual fails to complete either a drug awareness program or community service, or both (Sec. 1).
