Title: Prohibiting Text Messaging While Driving

Vote to pass a bill that prohibits individuals from writing, sending, or reading a text message using a handheld wireless communication device while operating a motor vehicle beginning July 1, 2010.

Highlights:

-Exempts individuals from the prohibition against text messaging while driving if the wireless communication device is being used (Sec. 1):

    -While the vehicle is lawfully parked; -To contact an emergency response vehicle; -To write, read, select, or enter a telephone number or name in an electronic wireless communications device for the purpose of making or receiving a telephone call; -When using voice operated or hands free technology; or -When operating an emergency response vehicle while making communications necessary to the performance of his or her official duties as an emergency responder.
-Classifies a violation of the prohibition against text messaging while driving as a misdemeanor punishable by a fine of up to $75 (Sec. 1).
