Title: Legalizing Alcohol Sales on Election Day

Vote Smart's Synopsis:

Vote to concur with House amendments and pass a bill that issues various amendments to statutes regulating alcohol, including legalizing the sale of alcohol on election day.

Highlights:
-Specifies that alcohol can be sold on election days in election precincts (Sec. 2). -Specifies that bars can be open on Sunday from 7am-3am the following day (Sec. 4). -Authorizes breweries to sell beer for carryout on Sunday, if the buyers buy 1 container that is not more than 576 ounces and the beer can only be sold at the address where the brewer's permit is issued (Sec. 6). -Authorizes an owner of an indoor theater to apply for an alcoholic beverage permit if the theater meets the following conditions (Sec. 8):
    -Located in a city that has a population of more than 200,000 but less than 300,000 people; and -Listed in the National Register of Historic place, and preserved and maintained under the National Historic Preservation Act of 1966.
-Authorizes a permittee charged with unlawfully furnishing an alcoholic beverage to use the purchaser producing a government issued document bearing the purchaser's photograph and showing the purchaser to be at least 21 years of age as a defense (Sec. 9). -Classifies a permittee or an employee or agent of a permittee to recklessly, knowingly, or intentionally sell, barter, exchange, provide, or furnish another person an alcoholic beverage for consumption off the licensed premises without first requiring the following as a Class B misdemeanor (Sec. 12):
    -A driver's license; -An identification card or a similar card issued under the laws of another state or the federal government; or -A government issued document bearing the person's photograph and birth date showing that the person is at least 21 years of age.
-Specifies that the purchaser being or reasonably appearing to be more than 50 years of age is a valid defense to violations of the above highlight (Sec. 12).
