Vote to concur with Senate amendments and pass a bill that authorizes the court to waive or reduce a mandatory minimum sentence for distributing, dispensing, or possessing with intent to distribute a controlled substance within 1,000 feet of a school.

Highlights:

-Authorizes the court to waive or reduce the following mandatory minimum sentences (Sec. 1):

    -3 years imprisonment, or between 1/3 and 1/2 of the sentence imposed, whichever is greater, for crimes involving substances other than marijuana; or -1 year imprisonment, or between 1/3 and 1/2 of the sentence imposed, whichever is greater, for crimes involving marijuana.
-Prohibits the court from waiving or reducing the mandatory minimum sentence if one of the following conditions apply (Sec. 1):
    -The offense took place while on school property; or -The defendant, during the commission of the crime, used or threatened violence, or was in possession of a firearm.
-Requires courts to consider the following factors in determining whether to waive or reduce a mandatory minimum sentence (Sec. 1):
    -Seriousness of the offense; -Specific location of the offense in relation to the school property and the reasonable likelihood of exposing children to drug-related activities; -Whether school was in session at the time of the offense; -Whether children were present at or in the immediate vicinity of the location when the offense to place; and -Defendant's prior criminal record.
