Vote Smart's Synopsis:

Vote to pass a bill that amends various statutes related to criminal justice for the purpose of budget reconciliation, including directing the Department of Administration to enter into one or more lease purchase agreements involving the sale and lease-purchase of state-owned facilities.

Highlights:
-Requires the Department of Administration to enter into one or more lease-purchase agreements by June 30, 2010 through the sale and lease-purchase of a Department of Corrections facility or any other state-owned facility, and requires that such agreement or agreements shall (Sec. 32):
    -Result in net available proceeds of no more than $250 million in the general fund by December 31, 2009; -Result in a total amount of net available proceeds of no more than $735.42 million in the state general fund by June 30, 2010; -Last for a fixed term of no more than 20 years; and -Require the initial lease-purchase payment to be in fiscal year 2010-2011.
-Specifies that any obligation under the aforementioned lease-purchase agreements shall not be a general obligation indebtedness of the state or the Department of Administration (Sec. 32). -Reduces fiscal year 2009-2010 appropriations for the Deoxyribonucleic Acid (DNA) Identification System Fund from $3.48 million to $980,000 (Sec. 21). -Increases minimum restitution and probation fees for offenders granted intensive probation from $50 to $75 (Sec. 7). -Increases minimum monthly supervision fees for individuals on standard probation from $50 to $65, and raises the minimum monthly supervision fees for individuals on intensive probation from $50 to $75 (Secs. 13-14). -Increases probation surcharge levied on every fine, penalty and forfeiture collected by the superior, justice, and municipal courts for criminal offenses and civil penalties collected for civil traffic violations and fines, penalties or forfeitures for violations of the motor vehicle statutes or local ordinances related to vehicles, except parking violations, or for violations of game and fish statutes from $10 to $20 (Sec. 2). -Limits the level at which the Department of Corrections shall reimburse for prisoner health and medical services to an amount that does not exceed the capped fee-for-service schedule that is adopted by the Arizona Health Care Cost Containment System Administration and in effect at the time services are delivered (Sec. 17).
